These Terms of Use relate to the website www.neyber.co.uk and any subsidiary websites we own.

We want everything we do to be clear and transparent and this starts with what you are agreeing to when you sign up with us. Please read these Terms of Use carefully - they set out the basis on how we provide our products and services to you. If you have any questions, please contact us at support@neyber.co.uk before using our websites.

These terms should be read alongside our:

• Our Privacy Policy – these tell you how we use the data we collect about you; and
• Our Cookie Policy – which tells you about the cookies that we use on our website.

These Terms of Use apply to all customers who create an account with us, you will be required to agree to them prior to using our services.

All and any borrowing facilities with Neyber Limited will be governed by separate product specific Borrower Terms and Conditions, these will be emailed to you when you take out one of these products. Before entering into any Loan Agreement you should make sure that you accept these Terms and Conditions and take, if you feel you need it, independent legal advice.

Who are we?



We are Neyber Limited (referred to as “we” or “us” or “our”). We are authorised and regulated by the Financial Conduct Authority (”FCA”). We are permitted to enter into regulated credit agreements as a lender, exercise, or have the right to exercise, lender's rights and duties under a regulated credit agreement, to carry out credit broking, to perform debt consolidation and debt adjusting activities, under the FCA reference number 718709.

Neyber Limited's registered address is;- First Floor, 3 Finsbury Avenue, London, EC2M 2AR.

We are registered with the Information Commissioner’s Office (registration number: ZA039009).

We are not covered by the Financial Services Compensation Scheme (“FSCS”), although some of the partners we work with may be. Please refer to their individual websites to establish if they are covered by the FSCS and refer to them with any questions you may have.

Our website



If you are browsing this website and/or are a registered borrower with us, then you may use the website for your own personal use.

We regularly review our website and will do our best to ensure that it is up to date. However if you notice that there is content that is inaccurate please let us know at support@neyber.co.uk.

We cannot guarantee that our website, or any content on it, will always be available or be uninterrupted. We do, however, have contingency plans in place and will try and keep any down time to a minimum.

We can’t guarantee that our website will be compatible with all or any hardware and software which you may use;

You must not use the website in any way that is unlawful or fraudulent. If we suspect you are doing so we reserve the right to suspend or close your account without notice.

When you wish to access any of our products or services you are required to register an account with us on our website, failure to do this will mean that you will not be able to use our services.

When you register with us, please ensure you provide us with correct information in all fields as failure to do so could result in you not being approved for some of our products. It is your responsibility to ensure your information is correct at all times.

During the registration process you will be required to authenticate the email address you supply us with, your account registration will not be complete until you have done this.

When you register an account with us you will be required to supply a password, you should keep this private, confidential and secure at all times. You should ensure your login details are always secure and never disclosed to anyone else, if you believe your login details have been compromised please contact us so that we can assist you.

If you give us false or inaccurate information, either directly or through an agent, and we suspect any type of fraud, we will record this and the information will be held and used in accordance with the terms of our privacy policy.

By registering an account with us, you agree to us sending you information about our financial wellbeing services such as notifications, articles, tips and wellbeing tools.

Our liability to you



We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
We do not have any liability to you if you use this website as a business user.

If you are a consumer user:

● please note that we only provide our site for domestic and private use.
● you agree not to use our site for any commercial or business purposes.
● we are only liable to you for losses which you suffer as a direct result of our breach of these terms of use. We have no liability to you for any loss of data, loss of profit, loss of business, business interruption, or loss of business opportunity if you operate a business.

You may have other rights granted by law, and these website Terms of Use do not affect these except if the two are inconsistent. If this is the case then these website Terms of Use will override any other rights which you may have, unless this is not permitted by law.

You may link to this website from another website without our consent in writing if you:
● link only to the homepage of this website;
● don’t create frames or any other border around the website;
● comply with all relevant laws and regulations on the website or platform you are linking from; and
● don’t imply that we endorse or are associated with your (or any other) website, product or service (unless we formally have agreed to). You may not link to this website from another website which contains inappropriate or distasteful content which may reflect badly on us.

Collecting your data


In order to provide our products and services we will require you to complete the relevant application forms, we will only use the data you provide for the specific purpose of the product you are applying for. There are 3 reasons why we will collect your data, these are:

  1. if you wish to take out a Neyber product, like a personal loan:
  2. if you wish to take out a financial services product supplied by one of our business partners, eg a savings account with Smarterly and
  3. you wish to use our Financial Wellbeing Hub for information and education purposes

If you begin any of the above journey’s but do not finish them we will send you a range of reminders offering tips and advice on how to complete them.

If you apply for a lending product with us we will assess your application using the information you provide, we will also use information from various other third party service providers, such as Credit Reference Agencies (“CRA”) and Fraud Prevention Agencies (“FPA”) (but not limited to these), to assist us in coming to a lending decision.

If you are applying for a product that is offered by one of our Business Partners (for example, Savings and Investment products with Smarterly), whilst we may direct you to their platform, you will be required to complete their application process in order to take one of their products. Neyber are not responsible or liable for the journey you experience with our Partners and you should refer to the Partner directly should you have any product specific questions.

Some other of the products you may apply for may not be directly provided by us and instead offered by one of our Business Partners. When this is the case, we will direct you to their website for you to continue your journey with them; we will inform you when we are making that introduction.

For all products taken with our Business Partners you should refer to and accept their Terms of Use and Privacy Policies and, if you take a product with them agree to their Terms and Conditions of the specific products you take too, Neyber are not liable for any of our Business Partners products.

We are not responsible for our Business Partner’s websites in any way, and us linking to them does not imply that we endorse their products.

When you take out any of the above products you accept that either the loan repayment or saving/investment contribution will be taken via a direct salary deduction from your net salary with your employer. This will take place on or around the date of your payday.

All of the content and material available on our website is for informational purposes only and should not be regarded as an offer, solicitation, invitation, advice or recommendation to you to buy or us to sell lending products, investments, securities or any other financial services or banking product. If you are unsure about whether our products and services are suitable for you, you should contact an independent financial adviser.

Website security



We use industry standard techniques to protect our website from viruses and attacks but cannot guarantee that our website will be free from viruses or other malicious software. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our website or to your downloading of any content on it, or on any website linked to it.

Your rights



You may have other rights granted by law, and these website Terms of Use do not affect these except if the two are inconsistent. If this is the case then these website Terms of Use will override any other rights which you may have, unless this is not permitted by law.

We are the owner of our website and all of the contents published on it. This includes copyright works and trademarks, which may or not be registered.
